REGULATIONS TERMS AND CONDITIONS OF THE WHOLESALE PANEL https://nutritionwholesale.eu
§ 1 DEFINITIONS
SELLER - is Trading Fitness Robert Szulborski available at ul. Sitarska 16 18-300 Zambrów, operating on the basis of a sole proprietorship, subject to entry into the Central Register of Economic Activities entered under the tax identification number: 759-172-39-45, REGON: 142592430
WHOLESALE PANEL - internet portal of the Seller, run at https://nutritionwholesale.eu, through which the Seller provides electronic services related to wholesale.
SALES AGREEMENT - means a sales agreement concluded remotely, on terms specified in the Regulations, between the Buyer and the Seller.
GOODS - means a product presented by the Seller via the Wholesale Panel website, which may be the subject of a Sales Agreement.
BUYER - means a wholesale customer who has registered an individual Account in the Wholesale Panel as a business entity (including a legal entity) running a business.
ACCOUNT - a subpage of the Wholesale Panel protected with an individual password, on which information about the Buyer and its orders is collected. Access to the panel is obtained by registering the Buyer and subsequent acceptance of the account by the Seller.
ORDER - a declaration by the Buyer's will clearly specifying the type and quantity of goods, aimed directly at the conclusion of the Sales Agreement.
RODO - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (general regulation on protection data).
§ 2 GENERAL RULES
These Regulations define the rules of using the Wholesale Panel available at https://nutritionwholesale.eu.
The wholesale panel is available to the Buyer after registration, via the registration form. The seller must approve the entity's access to the Wholesale Panel.
The Seller reserves the right to refuse access to the Wholesale Panel without giving a reason.
The condition for placing an Order in the Wholesale Panel by the Buyer is to read these Regulations and accept their provisions during the implementation of the Order.
Wholesale panel https://nutritionwholesale.eu conducts retail sales via the Internet.
All goods offered in the Wholesale Panel are brand new, originally packed, free from physical and legal defects, have been purchased from authorized entities in accordance with applicable law and are stored in the conditions specified in applicable regulations. Products in damaged packaging, which are discounted for this purpose, bear an appropriate annotation in this regard.
These Regulations, all rights and obligations arising from it, as well as those arising during the execution of the Order, are subject to Polish law.
As part of the technical requirements necessary to cooperate with the ICT system used by the Seller in order to make purchases, the Buyer should have an active e-mail account (e-mail) and a device connected to the Internet.
The buyer is obliged not to provide content prohibited by law, e.g. content that promotes violence, defamatory or violates personal rights and other rights of third parties.
The regulations may change. In the event of a change in the Regulations, the Seller shall place on the main page of the Wholesale Panel information on the change in the Regulations together with a summary of the changes introduced. Users who have an Account will be additionally notified of the change in the Regulations by sending information containing a list of amendments to the Regulations to the e-mail address assigned to the Account.
§ 3 SUBMITTING THE ORDER
All prices given in the Wholesale Panel https://nutritionwholesale.eu are gross prices. The prices do not include shipping costs.
Orders are accepted by the Wholesale Panel website.
Orders placed via the Wholesale Panel website can be placed 24 hours a day, 7 days a week throughout the year.
The order is effective if the Buyer correctly completes the order form and / or correctly provides contact details, including the exact address to which the product is to be sent and the telephone number and e-mail address.
If the given data is not complete, the Seller will contact the Buyer. If contact with the Buyer is not possible, the Seller has the right to cancel the Order. Which is tantamount to withdrawal from the Sales Agreement.
The Buyer in the order placement process may express the will to send electronically to the indicated e-mail address in the form of an electronic image of billing documents, in particular such as: VAT invoices with attachments, VAT invoices correcting with attachments and forms. This consent authorizes the Seller to issue and send VAT invoices in electronic form in accordance with the Regulation of the Minister of Finance of December 20, 2012. on sending invoices in electronic form, the principle of their storage and the mode of making them available to the tax authority or the fiscal control authority.
When placing the Order, the Buyer must agree to place personal data in the Seller's wholesale database of the Seller for processing - in connection with the execution of the Order. If consent is granted, the Buyer has the right to inspect their data, correct them and request their removal.
In order to register in the Wholesale Panel, the Buyer should provide a login and password necessary to access his account. The Buyer's login is the e-mail address provided by him. The password is a sequence of characters determined by the Buyer. The Buyer's password is not known to the Seller. The Buyer is obliged to keep it confidential and to protect against unauthorized access to third parties.
After placing an effective order by the Buyer, he will receive an automatic reply confirming the receipt of the order.
The start time depends on the method of payment for the Order. In the case of payment by bank transfer to the bank account indicated by the Seller, the completion of the Order takes place after the full amount has been credited to the Seller's bank account.
In the case of payment "on delivery (payment on delivery)" and in the case of express electronic payments (including payment by card), the commencement of the Order takes place within a maximum of three business days.
The Seller refuses to perform the Order in the following cases:
The buyer provided incomplete data, making it impossible to process the Order.
the product has been withdrawn from the market or stopped in circulation on the territory of the Republic of Poland after placing the order.
The Seller can not fulfill the Buyer's Order (incidental incompatibility of inventory or incidental damage to the goods).
In the cases mentioned in paragraph 13 The Seller undertakes to immediately (within 5 business days) counting from the day of placing the order, notify the Buyer via e-mail or telephone. If the Buyer has already paid for the Order, the Seller undertakes to return the full amount within 5 business days from the date of order.
§ 4 COSTS AND SHIPMENT DATE
The goods are sent to the address indicated in the Order form. The Seller shall inform the Buyer immediately about incorrectly completed Order Form, which prevents shipment or may delay it.
The goods are delivered with the help of specialized courier or forwarding companies. It is possible to collect your order personally at the company's headquarters (Zambrów, 16 Sitarska Street).
The parcel is delivered in accordance with the date given with each item on the website. This is an approximate delivery time and applies to orders with the "COD" delivery option. When choosing the payment option "transfer" or "payment by card or online transfer" until the time specified on the website, the time of posting the funds on the Seller's bank account should be added. (usually 1-2 business days). The seller reserves the maximum time of order completion up to five business days.
The buyer is charged for shipping (shipping) specified in the price list of transport. The customer can read the price list at any time by clicking the link (Shipping and payments).
If the Order cannot be correctly and timely delivered by the Buyer (wrong address, refusal to accept), the Seller reserves the right to charge the Buyer with the costs of re-delivery in accordance with the current delivery price list. Before accepting a parcel from a courier company, the Buyer is obliged to check whether the packaging has been damaged during transport. In particular, pay attention to the condition of the packaging, tapes affixed to the package. If the parcel is damaged, you must refuse to accept the parcel, and then contact the Seller via email or telephone to inform about the damaged parcel.
§ 5 PAYMENTS
We issue a VAT invoice for each item sold.
Payment for the ordered goods can be made on delivery (upon delivery of the goods), via electronic payment systems or by transfer to the Seller's bank account. In the case of a personal collection, there is a possibility of payment upon receipt of the Order.
§ 6 COMPLAINTS
The Seller is obliged to sell to the Buyer non-defective goods, with the exception of the discounted defective goods, which the Buyer ordered knowing about the defect. In the event of non-compliance of the goods with the contract or in the scope of irregularities in the provision of electronic services, the Buyer should report to the Seller a complaint via e-mail (email@example.com) or having an Account in the Wholesale Panel in the tab "YOUR ACCOUNT" and then complete the complaint form appearing after clicking the "Add a complaint" button.
Until the complaint procedure is closed, it is essential to keep all advertised goods intact.
If the product has a defect, the Buyer may submit a statement of price reduction or withdrawal from the contract, unless the Seller immediately and without excessive inconvenience to the Buyer replace the defective product free of defects or remove the defect. This limitation does not apply if the product has already been replaced or repaired by the Seller or the Seller has not satisfied the obligation to exchange the product for one free from defects or to remove the defect.
The Buyer may instead of removing the defect as proposed by the Seller, request replacement of the goods free of defects, or instead of replacing the goods, demand removal of the defect, unless bringing the goods to compliance with the contract in the manner chosen by the Buyer is impossible or would require excessive costs compared to the method proposed by the Seller.
The buyer can not withdraw from the contract under the procedure described in this §6 if the defect is irrelevant.
If the sold product has a defect, the buyer may also request replacement of the good for defect or removal of the defect. The seller is then obliged to replace the defective product with one free of defects or to remove the defect within a reasonable time without excessive inconvenience to the Buyer. The Seller may refuse to satisfy the Buyer's request if it is impossible to bring the defective goods into conformity with the contract in a manner chosen by the Buyer or would require excessive costs compared to the second possible way to bring the contract into conformity.
Advertised goods should be delivered to the Seller together with the completed "Complaint Report". We suggest labeling the parcel with the advertised goods with the information: "COMPLAINT OF GOODS". The advertised goods should be sent or delivered in person to: Fitness Trading ul. Sitarska 16 18-300 Zambrów. The seller does not accept parcels on delivery.
The Buyer has 7 business days from the date of receipt of the parcel to report the complaint to the Seller. Complaints submitted after 7 business days will not be considered by the Seller.
The Seller will respond to the request (complaint) submitted by the Buyer within 14 days from the date of receipt of the request. If the Seller refuses to respond within the specified period, it is considered that the request was considered justified.
Advertised goods, sent back by the Buyer for repair (removal of defects), the Seller shall immediately send them to the appropriate service point.
If the complaint is rejected by the Seller, the Buyer may use the help of the municipal or poviat consumer ombudsman, voivodeship inspectorates of the Trade Inspection or one of the social organizations, whose statutory tasks include consumer protection, e.g. the Consumer Federation. Detailed information on out-of-court complaint and redress procedures is available at the premises or on the websites of consumer ombudsmen, voivodeship inspectorates of the Trade Inspection, relevant social organizations and addresses available on the website of the Office of Competition and Consumer Protection: www.uokik.gov.pl/wazne_adresy .php.
If the complaint is rejected by the Seller, the Buyer may use extrajudicial proceedings to resolve the dispute. The entity competent to conduct such proceedings is the Provincial Inspector of Trade Inspection in Białystok, whose website is available at: http://www.bialystok.wiih.gov.pl

§ 7 DATA PROTECTION
The Seller guarantees strict protection of personal data provided by the Buyer and processing them solely for the purpose of the contract or for purposes for which the Buyer has consented, subject to the requirement of personal data security specified in the provisions of the Act of August 29, 1997 on Personal Data Protection Journal of Laws of 2016, item 922, as amended)
The administrator of personal data of the Wholesale Panel operating at https://nutritionwholesale.eu is Robert Szulborski, who is the owner of Fitness Trading, Robert Szulborski, ul. Sitarska 16 18-300 Zambrów. Personal data are archived in the office of the company located at: Fitness Trading ul. Sitarska 16 18-300 Zambrów.
The seller shall process personal data in order to perform the contract based on art. 6 par. 1 lit. b RODO and that you obtain this data from customers. The Buyer provides the Seller with personal data voluntarily, however, being aware that they are necessary to conclude a Sales Agreement.
Personal data is stored in a safe way for the Buyer for an indefinite period of time, in order to conduct the wholesale panel's rebate policy and for tax purposes during the statutory period.
The buyer has the right to rectify, delete or limit processing, as well as the right to object to the processing and the right to transfer his personal data.
The buyer has the right to lodge a complaint to the supervisory body, which is the General Inspector of Personal Data.
The Seller undertakes to observe the confidentiality of the Buyer's data and not to disclose such data to unauthorized persons. He also undertakes to adequately protect this information from unauthorized access.
In order to ensure the safety of Buyers, the Seller takes technical and organizational measures appropriate to the degree of security risk of the services provided.
In matters not covered by these regulations, the provisions of the Civil Code and relevant laws of Poland, as well as European Union law, in particular the GDP, shall apply.
Regulations come into force on 25/05/2018.
